Terms of Service for BoothBrain

Agreement to Terms

By accessing or using BoothBrain ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

BoothBrain is a mobile application that provides inventory management, point-of-sale, and sales tracking tools for vendors and small business owners.

Account Registration

Account Creation

  • You must create an account to use the App
  • You must provide accurate and complete information
  • You must be at least 18 years old
  • You are responsible for maintaining account security
  • You are responsible for all activity under your account

Account Security

  • Keep your password confidential
  • Notify us immediately of any unauthorized access
  • We are not liable for losses due to unauthorized use of your account

Subscription and Payments

Subscription Plans

  • BoothBrain offers monthly and yearly subscription plans
  • Free trial may be available for new users
  • Pricing is available in the App and subject to change

Payment Processing

  • Payments are processed securely through Stripe
  • You authorize us to charge your payment method automatically
  • Subscription renews automatically unless cancelled
  • You can cancel anytime through your account settings

Refunds

  • Refunds are handled on a case-by-case basis

  • We may offer prorated refunds at our discretion

Price Changes

  • We may change subscription prices with 30 days notice
  • Continued use after price change constitutes acceptance
  • You may cancel before the price change takes effect

Acceptable Use

You May

  • Use the App for lawful business purposes
  • Store your inventory and sales data
  • Process customer transactions
  • Export your own data

You May Not

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit malware or harmful code
  • Attempt to hack or reverse engineer the App
  • Use the App to sell illegal products
  • Share your account with others
  • Resell or redistribute the App

User Content

Your Data

  • You retain ownership of your business data
  • You grant us license to store and process your data to provide the service
  • You are responsible for backing up your data
  • We are not liable for data loss (though we maintain backups)

Product Photos

  • You must own or have rights to any photos you upload
  • You grant us license to store and display your photos in the App
  • Do not upload copyrighted images without permission

Intellectual Property

Our Rights

  • BoothBrain, including all code, design, and content, is our property
  • Our trademarks and logos are protected
  • You may not copy, modify, or distribute the App

Your License

  • We grant you a limited, non-exclusive, non-transferable license to use the App
  • This license terminates if you violate these Terms

Disclaimers

"AS IS" Service

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OF DATA
  • UNINTERRUPTED SERVICE

Use at Your Own Risk

  • We do not guarantee the App will be error-free
  • We do not guarantee data accuracy
  • You are responsible for verifying sales data and calculations
  • Use the App as a tool, but verify critical business data independently

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
  • WE ARE NOT LIABLE FOR LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE LAST 12 MONTHS
  • SOME JURISDICTIONS DO NOT ALLOW LIMITATION OF LIABILITY, SO THIS MAY NOT APPLY TO YOU

Termination

By You

  • You may cancel your subscription and delete your account at any time
  • Data will be deleted according to our Privacy Policy

By Us

  • We may suspend or terminate accounts that violate these Terms
  • We may terminate accounts for non-payment
  • We will provide notice when possible, except in cases of serious violations

Dispute Resolution

Arbitration

  • You agree to attempt informal resolution before filing any claim

Updates to Terms

  • We may update these Terms at any time
  • Changes will be posted in the App and on our website
  • Continued use constitutes acceptance of changes
  • Material changes will require your consent
